National Interest Waiver Jobs: Who Can Qualify?

To qualify for a National Interest Waiver, you will first need to meet the basic requirements of an employment-based immigrant visa.

Specifically, you will need to demonstrate either:

  • An advanced degree (or foreign equivalent), which is required by your prospective job, OR
  • An exceptional ability in the sciences, arts, or business (significantly above what is normally encountered in your field)

If you can demonstrate either an advanced degree or exceptional ability, you may qualify for a National Interest Waiver if:

  • Your prospective work or endeavor has both merit and national importance
  • You are well-positioned to develop or complete this work
  • It would be in the United States’ best interests to waive the requirements of a job offer and coinciding labor certification (i.e. substantially benefiting the U.S. economy, welfare, or cultural/educational interests)

If you qualify, your green card application process can be substantially faster than normal. However, your likelihood of success is generally lower than if you went through the standard labor certification and employer sponsorship process.
