National Interest Waiver Attorneys in San Diego

National Interest Waiver Attorneys in San Diego

In most employment-based immigration cases, a U.S. employer must sponsor a prospective employee from another country. A significant element of the application process involves demonstrating a future employer-employee relationship and in some cases a labor certification for the sponsored job. Additionally, if you are self-employed and the owner of your own business, the traditional employer-sponsored immigration case may not be available to you.

In some cases, however, the bona fide job offer requirement can be waived. If you are eligible for a National Interest Waiver, you can self-petition, meaning you can file Form I-140, Petition for Alien Worker with USCIS yourself. At Jacobs & Schlesinger, our legal team can assess your situation and determine whether you may qualify for a National Interest Waiver. We can then help you through every step of the application process.

National Interest Waiver Jobs: Who Can Qualify?

To qualify for a National Interest Waiver, you will first need to meet the basic requirements of an employment-based immigrant visa.

Specifically, you will need to demonstrate either:

  • An advanced degree (or foreign equivalent), which is required by your prospective job, OR
  • An exceptional ability in the sciences, arts, or business (significantly above what is normally encountered in your field)

If you can demonstrate either an advanced degree or exceptional ability, you may qualify for a National Interest Waiver if:

  • Your prospective work or endeavor has both merit and national importance
  • You are well-positioned to develop or complete this work
  • It would be in the United States’ best interests to waive the requirements of a job offer and coinciding labor certification (i.e. substantially benefiting the U.S. economy, welfare, or cultural/educational interests)

If you qualify, your green card application process can be substantially faster than normal. However, your likelihood of success is generally lower than if you went through the standard labor certification and employer sponsorship process.

Because of the additional requirements and lower approval rate, working closely with a qualified San Diego immigration attorney is imperative. At Jacobs & Schlesinger, we have decades of combined experience and know exactly what USCIS will need to see to grant a National Interest Waiver.
