Apply for Deferred Action for Childhood Arrivals

On June 15, 2012, an order was issued allowing people who came to the U.S. as children (who meet specific requirements) to apply for deferred action regarding their removal from the country. If approved, this status must be renewed every two years. DACA recipients are able to apply for work authorization nationally and driver’s licenses in many states, including California. Essentially, DACA is a status which protects young noncitizens who do not pose a threat to national security from deportation.

Requesting DACA is a long and complex process that can be difficult to do on your own. With a knowledgeable San Diego DACA attorney by your side, your application will be made simple and stress-free. At Jacobs & Schlesinger, we have helped hundreds of people attain DACA status and look forward to assisting you with your application.

Guidelines for Deferred Action for Childhood Arrivals

At Jacobs & Schlesinger, we understand that applying for DACA can be confusing and overwhelming. It also doesn't guarantee citizenship or an opportunity for residency. Speaking with a San Diego immigration lawyer as soon as possible is in your best interest to gain an understanding of your options.

We have extensive experience helping clients determine whether they are eligible for DACA and carefully putting together thorough applications which anticipate and proactively address potential pitfalls and concerns.

You may request to be considered for deferred action if you meet the following:

  • Under 31 years old at the time DACA was announced
  • Under 16 years old when you first entered the U.S.
  • Have lived in the U.S. continuously since June 15, 2007
  • Present in the United States when DACA was announced
  • In the U.S. while applying for deferred action
  • Not been convicted of any serious criminal offense
  • Currently go to school, graduated high school, obtained a GED, or are actively serving in or have been honorably discharged from the military

How Do I Benefit from Deferred Action?

If your application for deferred action is approved, you will legally be allowed to work in the U.S. You will also be allowed to apply to travel outside of the U.S (make sure you talk to your attorney before you do so.) If you meet the guidelines listed above, consulting with a San Diego DACA attorney from Jacobs & Schlesinger is in your best interest. We can work with you to determine whether you qualify and help you prepare a very strong application. Our experience and wealth of knowledge of immigration law can only serve to benefit your case. We also offer in-house financing for your convenience.
