What Are the Grounds for Asylum?

Political asylum is protection by the United States for those who fear persecution or have faced persecution in their home country due to their:

  • Religion
  • Nationality
  • Political opinion
  • Social membership; and/or
  • Race.

If you are persecuted or fear being persecuted for any of the reasons above, you maybe qualified for asylum.

How Can I Seek Asylum?

Regardless of the manner of entry and your current immigration status, you may apply for asylum so long as you can establish the validity of your fear of persecution in your country of origin within one year of entry into the United States. You may include your spouse and children in your application. While this may seem easy, you need to understand that there are exceptions to this one-year requirement.
To receive asylum, a thorough application will have to be filed with the United States Citizenship and Immigration Services (USCIS). After which, you will have to attend an interview at the asylum office with your experienced attorney(s).
Asylum cases are very complex and each case is treated differently. Asylum applications are either adjudicated by USCIS or by an Immigration Judge and include applications for withholding of removal and protection under the United Nations Convention Against Torture.

Can I Obtain a Green Card After Asylum Approval?

Asylum status can be revoked anytime, thus, the grant of asylum does not guarantee you an automatic permanent residency. If you wish to obtain a green card will have to wait at least one year for status adjustment.
As it is not automatic, you must comply with all the requirements as a non-asylum applicant for permanent residency. Moreover, you must continue to meet the definition of a refugee or a spouse or a child of a refugee, and the asylum must not have been terminated.
