The E-2 Investor Visa for Temporary Status

The E-2 visa is a nonimmigrant (i.e. temporary) visa for international investors. The initial period is no more than 2 years, but visa holders can request extensions in 2-year increments. There is no limit to how many times an E-2 visa holder can request an extension, but they must continuously demonstrate an intent to leave the U.S. after their visa expires.

Requirements for the E-2 Visa

To qualify for an E-2 investor visa, you must be:

  • From a country that maintains a commerce and navigation treaty with the U.S. such as Mexico, Chile, and more. See the current list of treaty countries here.
  • Investing a substantial amount of capital into a U.S. enterprise
  • Seeking entry into the U.S. solely to continue this investment process (i.e. owning 50% of the enterprise or possessing operational control)
  • Working only in the approved activities for the duration of stay (with certain exceptions)

If you qualify, your employees and dependent family members may qualify for the E-2 visa as well.

EB-5 Immigrant Investor Visa for Lawful Permanent Residence

What is an investor visa? If you are looking to obtain a green card as an immigrant investor, you will need to apply for the EB-5 visa. EB-5 investor visa holders represent roughly 7% of the 140,000 employment-based green cards distributed every year. These visas are meant to allow foreign investors to develop U.S. commercial enterprises that create both jobs and capital. If you obtain an EB-5 visa, you will not need labor certification.

The categories within the EB-5 visa include:

  • I5: Investor Pilot Program in a targeted area
  • T5: employment creation in a targeted rural or high-unemployment area
  • R5: Investor Pilot Program outside a targeted area
  • C5: employment creation outside a targeted area

What Are the EB-5 Visa Requirements?

To qualify for an EB-5 investor visa, you must invest—without borrowing—at least:

  • $1,800,000;
  • $900,000 in a rural area; or
  • $900,000 in an area with a high rate of unemployment

Within 2 years, your investment must create full-time jobs for at least 10 U.S. workers (i.e. citizens, lawful permanent residents, or certain authorized immigrant workers). This number of workers cannot include your family members.

To apply, you will need to file Form I-526, Immigrant Petition by Alien Entrepreneur. Once this is approved by USCIS, you can then apply for an immigrant visa at a U.S. Embassy or Consulate. Filing for an investment visa can be difficult to navigate with an investor visa attorney on your side.
